No it does not. Therfore, it could be included in the kernel. it is already part of the latest 
linux 2.6.27-rc kernel

No. The ath9k driver is for 802.11n devices from atheros. The ath5k driver is still required for 802.11abg
devices. There was now a patch for ath5k to remove all n devices, in this regard, ath9k is a replacement.
